To 12.00 midnight in the eve of "Arulmigu Sri Othapannai Sudalai Andavar Thirukovil" at Mela Alangulam, Srinivasagapuram, Ervadi Post, Naganeri Taluk, Tirunelveli District by considering the petitioner's representation dated 06.08.2018. ORDER
This Writ Petition has been filed for a direction to the respondents to grant permission and necessary protection to perform Karagattam and Magudam Arambam and Pattimandram. 2.The learned counsel appearing for the petitioner submitted that the families belonging to the Alangulam Village used to conduct festival during Avani Tamil Month at Arulmigu Sri Othapannai Sudalai Andavar Thirukovil every year. This year the villagers have decided to conduct Karagattam, Magudam Arambam and Pattimandram on 31.08.2018 between 09.00 P.M. to 12.00 midnight. This festival is conducted every year during this time and it has been done in peaceful manner without giving raise to any law and order problem. For the purpose of conducting programs during the said festival, a representation was made to the second respondent on 06.08.2018. However, the respondents have not granted any permission till date to conduct the said program.
3.The learned Government Advocate appearing for the respondents submitted that it is true that the villagers belonging to Alangulam Village have conducted this festival every year in Avani Tamil https://hcservices.ecourts.gov.in/hcservices/
Month. However, as per the orders of this Court and the consequent Government Orders, loud speakers cannot be permitted to be used beyond 10.00 PM.
4.Taking into consideration of the fact of auspicious nature of the festival, the second respondent is directed to consider the representation made by the petitioner and grant permission and necessary protection to perform Karagattam, Magudam Arambam and Pattimandram between 09.00 pm to 12.00 midnight on 31.08.2018. The second respondent is at liberty to impose any conditions, that are necessary for peaceful conduct of the above said programs without giving raise to any law and order problem and the petitioner is bound to comply with the conditions to be imposed by the second respondent.
5.With the above observations, this Writ Petition is allowed. No costs.
