This Petition is filed to condone the delay of 348 days in preferring the above Civil Miscellaneous Appeal.

2.Heard the learned counsel for the Petitioner and perused the materials placed before this Court. No representation for R1. R3 name printed in the cause list.

3. The counsel for 4th respondent / Insurance Company stated that the petition to be allowed subject to the condition that the petitioner is not entitled to interest for the delay period.

4. For the reasons stated in the accompanying affidavit filed in support of the Petition and on being satisfied with the same, this Petition is ordered and the delay is condoned on condition that the claimant is not entitled to interest for the default period.
