Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the offences punishable under Section 306 of IPC., in Crime No.206 of 2018, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant's son borrowed a loan from the second accused and others, due to which, defacto complainant's son was already committed suicide. In this regard on 24.07.2018, at about 03.00.p.m., the petitioner met the victim in her house and demanded the amount borrowed by her son. Thereafter, at about 06.30.p.m., she consumed pesticide, immediately, she was taken to the Government Hospital, Dindigul, but she died on 30.07.2018. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution. Further, there is no suicide note or any statement recorded by the respondent from the deceased. Hence, he prays for grant of anticipatory bail to the petitioner.

4. Heard learned Additional Public Prosecutor for the respondent.

Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Dindigul and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.30.a.m., until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
