Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to allot Plot Nos.64 to 67 at SIDCO Industrial Estate, Rajapalayam Taluk, based on the petitioner's application dated 05.09.2007 at the rate prevailing on the date of application within time stipulated by this Court.

ORDER

This writ petition is filed seeking a writ of Mandamus to direct the respondents to allot Plot Nos.64 to 67 at SIDCO Industrial Estate, Rajapalayam Taluk, based on the petitioner's application dated 05.09.2007 at the rate prevailing on the date of application, within the time stipulated by this Court. 2.The case of the petitioner is that Plot Nos.58 and 59 in SIDCO Industrial Estate, Rajapalayam, have been allotted to the petitioner on outright sale, wherein he is running an industry. As he wanted to develop his industry, he made an application dated 05.09.2007 to the respondents seeking to allot Plot Nos.64 to 67, https://hcservices.ecourts.gov.in/hcservices/

which are situated adjacent to his present unit. Since the same has not been considered so far, the petitioner is before this Court. 3.The learned counsel for the petitioner would submit that it would be suffice, if the application of the petitioner dated 05.09.2007, is disposed of by the first respondent, as per law. 4.The learned Government Advocate appearing for the respondents would submit that the application of the petitioner shall be considered in accordance with law and till considering the application of the petitioner, no allotment would be effected. 5.Considering the above said submissions, this Court, without going into the merits of the petitioner's claim, directs the respondents to consider the application of the petitioner dated 05.09.2007 and pass appropriate orders on its own merit and in accordance with law, after affording due opportunity of hearing to the petitioner, within a period of six weeks from the date of receipt of a copy of this order and till considering the application of the petitioner, no allotment be effected.
