This Criminal Original petition has been filed to direct the first respondent to execute the Warrant issued by the Judicial Magistrate, Manapparai in S.T.C.No.05 of 2021 dated 06.03.2021. 1/4
2.The learned counsel appearing for the petitioner submitted that the petitioner has filed a petition before the Judicial Magistrate Court, Manapparai, seeking for recovery of the amount of Rs.5,00,000/- which was received by the second respondent and take necessary action against the second respondent. Thereafter, the learned Judicial Magistrate has issued summon to the second respondent, but he has not appeared before the concerned Court. Due to which, the learned Judicial Magistrate, Manapparai, has issued Non Bailable Warrant against the second respondent on 06.03.2021. Till now, the first respondent Police has not executed Non Bailable Warrant against the second respondent. 3.Considering the above facts and circumstances of the case, the first respondent is directed to execute Non Bailable Warrant issued against the second respondent in S.T.C.No.05 of 2021 within a period of four weeks from the date of receipt of a copy of this order. 2/4
4.With the above direction, the Criminal Original Petition is disposed of.
