PRAYER:

Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the first respondent to conduct an enquiry under the Tamil Nadu Patta Pass-book Act 1983, pertaining to two Patta issued by the second respondent in respect of the petitioner family lands situated at V.Karisalkulam, Thirichuli Taluk, Virudhunagar District bearing survey Nos.21/11A, 21/11B. For Petitioner : Mr.R.Murugappan For Respondents : Mr.C.Selvaraj, Special Government Pleader.

ORDER

The petitioner filed this writ petition for issuance of a Writ of Mandamus, directing the first respondent to conduct an enquiry under the Tamil Nadu Patta Pass-book Act 1983, pertaining to two Patta issued by the second respondent in respect of the petitioner family lands situated at V.Karisalkulam, Thirichuli Taluk, Virudhunagar District bearing survey Nos.21/11A, 21/11B.

2. By consent of both sides, this writ petition is taken for final disposal at the stage of adjourned admission itself. https://hcservices.ecourts.gov.in/hcservices/

3. The case of the petitioner is that the lands in Survey Nos.21/11A, 21/11B and 33/1B originally belong to his father Irulandi, S/o.Periyakaruppa Thevar. Patta was issued in favour of the petitioner's father in patta No.20. While so, the second respondent issued another patta in favour of the dead person namely one Irulandi Velar in patta No.456. Hence, the petitioner sent a representation to the first respondent on 20.06.2017 to rectify the mistake. Since no action was taken, the present writ petition has been filed.

4. In view of the above fact, without going into merits of the case, this Court directs the first respondent to consider the representation of the petitioner and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order after providing opportunity to all necessary parties.

5. This Writ Petition is disposed of with the above direction. No costs.
