ORDER : The Court made the following order :- The petitioners, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.186 of 2024, for the offence under Sections 147, 294(b), 323, 324 and 506(i) IPC, have filed this petition seeking anticipatory bail.
2. The case of the prosecution is that on 06.06.2024 at about 11.00 a.m., the petitioners and others assaulted the defacto complainant in front of the Sub-Registrar, Guziliamparai.
3. The learned counsel appearing for the petitioners submits that the defacto complainant, who is the aggressor, has assaulted A1, who is the father of A2 and on retaliation, A2 has assaulted the defacto complainant. He further submits that subsequent to that incident, A1 and A2 were arrested and they are in jail. The petitioners herein are arrayed as A3 to A5 and there is no specific overt act attributed against the petitioners. Hence, he prays for grant of anticipatory bail to the petitioners.
4. The learned Government Advocate (Crl. Side) submits that the investigation is yet to be completed.
5. Considering the nature of allegations and also considering the fact that the alleged occurrence had taken place in a public place and that too in front of the SubRegistrar, this Court is not inclined to grant anticipatory bail to the petitioners. 2/3
