O R D E R

This petition is filed seeking a direction to the second respondent not to harass the petitioners under the guise of enquiry based on the complaint given by the third respondent.

2. The case of the petitioners is that the petitioners are husband and wife and the first petitioner borrowed a sum of Rs.38,000/- from the third respondent 2 1⁄2 years back and the same was repaid in installments. But however, the third respondent claims that the first petitioner has to pay Rs.70,000/-. On that basis a complaint was given by the third respondent.

The learned Additional Public Prosecutor would submit that the second respondent is calling the petitioners for enquiry based upon the complaint given by the third respondent in CSR No.648 of 2021 and during the course of enquiry both parties gave a statement to the effect that Rs.50,000/- was borrowed by the first petitioner and the petitioners undertook to pay it in installments and on that basis it came to be closed on 24.06.2021.

4. However, the counsel for the petitioner would submit that even after closure of the enquiry he has received a call from the second respondent. Probably call might have been made with regard to the pendency of this petition. Since the petition has already been closed, nothing survives in this petition for further consideration or direction.

5. In the result, this petition is disposed of.
