PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing respondent Nos.1 to 4 to conduct survey of the land in Survey No.85/17A measuring to the extent of 21-1/2 cents situated in Navinipatti Village, Melur Taluk, Madurai District by considering the petitioner's representations dated 25.01.2019 and 04.06.2019 and Patta No.3536 issued by the first respondent and fix the four boundaries with the assistant of Melur Police and issue the report of survey or acknowledgement of completion of survey and Survey Sketch within the time fixed by this Court.

The petitioner, aggrieved by the inaction on the part of the survey officials in not conducting survey despite the petitioner having made an application way back in 04.06.2019 has come forward with the present writ petition.

2.It is the grievance of the petitioner that despite attempts to survey and dispose of the petitioner's application, even in the year 2019 at the instance of the respondent No.5, survey was not successfully conducted. Hence, the petitioner seeks expeditious consideration of his survey application.
3.However, learned Government Advocate would submit that in terms of the prevailing rules and regulations, the petitioner will have to make online application for survey. In view of the above, the petitioner is directed to make necessary online application for survey to be conducted in terms of his earlier application dated 04.06.2019 and if necessary pay any additional charges, if required. On such online application being made by the petitioner, the first respondent with the assistance of the third respondent, shall fix a date for survey and cause advance notice to the petitioner as well as fifth respondent. In the event of any objections being received by the first and third respondents, the same shall be dealt with in accordance with law and disposed of, before conducting survey. The survey shall be conducted within a period of eight [8] weeks from the date of receipt of a copy of this order. It shall be open to the second respondent to seek police protection for preventing any breach of 3/6
law and order and the expenses in connection with the same shall be met by the writ petitioner.
4.Accordingly, the Writ Petition stands disposed of. There shall be no order as to costs.
