By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself.
2. According to the petitioner, the Additional Chief Secretary/Commissioner of Revenue Administration, the second respondent herein passed an impugned order dated 22.02.2021 imposing the punishment of dismissal from service of the petitioner for illegal gratification of money from the innocent poor people for providing free house site pattas to them. Challenging the aforesaid order, the petitioner has preferred an appeal to the first respondent on 24.03.2021 and the same is pending before the concerned authority.
Thereafter, the petitioner made a representation on 17.06.2021 to the first respondent requesting to dispose of the aforesaid appeal dated 24.03.2021 at the earliest. https://hcservices.ecourts.gov.in/hcservices/ 1/2
W.P.(MD) No.13882 of 2021 But till date, the said representation is pending, and no orders were passed. Hence, the petitioner has filed the present Writ Petition.
3. The learned Government counsel appearing for the respondents would submit that if such an appeal is pending, the same shall be considered and orders will be passed in accordance with law
4. In view of the above submissions of the parties, without expressing any opinion on merits, this Court is inclined to direct the first respondent to consider the appeal preferred by the petitioner dated 24.03.2021 on its own merits and in accordance with law and pass appropriate orders preferably within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above directions, the Writ Petition is disposed of. No costs.
