ORDER

This Writ Petition is filed seeking Writ of Mandamus, directing the third respondent to hear petitioner's objection, if any documents filed for registration before him by the third parties in connection with his property bearing Survey No.518/2 with an extent of 0-93.50 Ares - Patta No.2223, situated at Vellalapatti Village, Manapparai Taluk, Tiruchirappalli District.

2. The contention of the petitioner is that the patta for the above land stands in his name. But the second respondent without issuing any notice, cancelled the patta which stood in his name. Therefore, the petitioner has also filed an objection before the first respondent which is pending for adjudication. In the meanwhile, the petitioner has filed an appeal restraining the third respondent /Sub Registrar from registering any document in respect of the above land, based on the change of patta, to the third parties. Since the same was not considered the petitioner is seeking direction to the third respondent. 2/5

3. Heard both sides and perused the materials available on record. With the consent of both parties, the matter is taken up for final disposal at the admission stage itself.

4. This Court, directs the first respondent to consider the appeal filed by the petitioner and pass appropriate orders within a period of four weeks from the date of receipt of a copy of this order. After passing of the order, the petitioner is directed to submit the order before the third respondent to consider his objection based on the order passed by the first respondent. The third respondent is directed to consider the petitioner's objection as per law within a period of six weeks thereafter.

5. With the above direction, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition stands closed. 04.06.2025 NCC : Yes / No Index : Yes / No Internet : Yes/ No pnn 3/5
