PRAYER :- To enlarge the petitioner on bail in Crime No.282 of 2024 on the file of the respondent police ORDER : The Court made the following order :- The petitioner, who was arrested on 28.05.2024 for the alleged offence under 1/4

Sections 273 and 328 of IPC r/w 24(1) of Cigarette and Tobacco Products Acts, 2003 in Crime No.282 of 2024, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that the petitioner was selling the banned tobacco products. Hence, the complaint.

3.The learned counsel for the petitioner submits that the petitioner is not aware that selling of tobacco products is a prohibited one. Now, he is prepared to file an affidavit of undertaking before the concerned Police station that he will not indulge in any offence in future. Realizing his mistake, he has donated a smart Television for arranging a smart class room in a Government School, Alanganallur, Madurai. 4.Considering his change of attitude, considering the period of incarceration, this Court is inclined to grant bail to the petitioner with some conditions.

5. Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail on the following conditions:- i) The petitioner shall execute a bond for a sum of Rs.1,00,000/-(Rupees One Lakh) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I,Kulithurai, Karur.

ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the Government in proof of their residence address; iii) The petitioner shall report before the respondent police daily at 10.30 a.m 2/4

until further orders. He has to co-operate for interrogation. iv) The petitioner shall file an affidavit of undertaking before the respondent police that he will not indulge in any offence in future. v) The petitioner shall not misuse the liberty granted to her by indulging in any further offence and shall not tamper with the prosecution witnesses. The petitioner shall be available for the trial as well.
