Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the second respondent to consider the petitioner's representation dated 29.08.2016 based on the guidelines issued by the second respondent in Memo No.114124/G11/G111/ 2001-2, dated 03.01.2002 within a stipulated time as fixed by this Court and consequently post the petitioner as Junior Engineer Mechanical Grade-I, as per his panel seniority in Tuticorin.

ORDER

The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the second respondent to consider the petitioner's representation dated 29.08.2016 based on the guidelines issued by the second respondent in Memo dated 03.01.2002 within a time frame and subsequently, post the petitioner as Junior Engineer Mechanical Grade-I, as per panel seniority in Tuticorin Thermal Power Station, Tuticorin.

2. The learned Counsel appearing for the petitioner submitted that it would be suffice to direct the second respondent to consider the petitioner's representation dated 29.08.2016 within a time frame.

3. Mr.A.V.Ramanathan, learned Counsel taking notice for the respondents submitted that the second respondent may be directed to

consider the petitioner's representation on merits and in accordance with law within a time frame.

4. Having regard to the submissions made by the learned Counsel appearing on either side, taking into consideration the limited prayer sought for in the writ petition, without expressing any opinion with regard to the merits of the case, I direct the second respondent to consider the petitioner's representation dated 29.08.2016 and pass orders on merits and in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

5. With the above observations, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
