PRAYER :- To enlarge the petitioner on bail in connection with the Sessions Case in S.C No. 22 of 2023 on the file of the III Additional Sessions Judge, Tirunelveli in FIR in Crime No. 118 of 2013 on the file of the respondent police ORDER : The Court made the following order :- The petitioner/A11 herein was arrested and remanded to judicial custody on 04.01.2023 for the alleged offence under Sections 120(B), 147,148,341,302 r/w.149 of IPC in Crime No.118 of 2023 on the file of the respondent police seeks bail.
2. Originally the petitioner was granted bail in Crime No.118 of 2013. The respondent after completion of investigation filed final report and the same waas taken on file in S.C. No. 22 of 2023 and pending on the file of the learned III Additional Sessions Judge, Tirunelveli, however the petitioner failed to appear before the trial Court on 11.11.2021, as such Non Bailable Warrant was issued against him. While pending Non Bailable Warrant he involved in so many cases and he was arrested and remanded to judicial https://www.mhc.tn.gov.in/judis
custody and he was produced on P.T warrant in this case inorder to execute the Non Bailable Warrant issued as against him. Now the case stands posted for examination of L.W. 1to L.W.3 and at this stage if the petitioner is released on bail, he may abscond again and the entire trial will be stalled. Further the petitioner also involved in 23 previous cases
4. Taking into consideration the serious offence committed by the petitioner this Court had already dismissed the petition filed by the petitioner on 18.04.2023 in Crl.O.P(MD) No.7147 of 2023.
