Pleased to set aside the Judgment of conviction passed by the learned Special Judge for Prevention and Corruption Act Cases at Madurai in Special Case No.55 of 2011 by allowing this appeal. Prayer in CRL MP(MD). 3674/ 2018 :
To suspend the sentence of 2 years on us imposed by the Learned Special Judge for Prevention of Corruption Act Cases at Madurai by his Judgement dated 28/04/2018 in Special Case No.55/2011. Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.VINAYAGAN.K, Advocate for the petitioner and of Mr.R.SIVAKUMAR, Government Advocate(crl.side) on behalf of the Respondent, the court made the following order:- This petition has been filed to modify the conditions passed in Crl.M.P(MD)No.3674 of 2018 in Crl.A.(MD)No.246 of 2018, dated https://www.mhc.tn.gov.in/judis 1/2
CRL MP(MD) No.7551 of 2023 18.05.2018 that the petitioner may be permitted to sign any other day in the month of June 2023 instead of 1st working day of June 2023 instead of 1st working day of June 2023.
2.The learned counsel for the petitioner submitted that since the temple festival to be commenced in the last week of May 2023, the petitioner seeks the above modification.
3.The learned Government Advocate (Crl.Side) submitted that the petitioner has been complying with the condition regularly. 4.Considering the nature of offence, the condition imposed by this court in Crl.M.P(MD)No.3674 of 2018 in Crl.A.(MD)No.246 of 2018 dated 18.05.2018 is modified only in the month of June 2023 alone and the petitioner shall report before the trial Court on 11.06.2023 and for the other months, the earlier order of this Court remains unaltered.
