ORDER
(Order of the Court was made by M.M.SUNDRESH, J.) The petitioner seeks a writ of Mandamus against a Bank, which is not an instrument of the State, over a commercial transaction. As rightly submitted by the respondents 2 and 3, the writ petition as filed is not maintainable. The petitioner's account has been declared as Non Performing Assets. In fact, the problem started in the month of March 2020. At that time, one time settlement has been arrived at, which has been defaulted by the petitioner. The contentions raised cannot be gone into for two reasons, namely, respondents 2 and 3 are not amenable to Article 12 of the Constitution of India and the transaction is commercial in nature. Further more, arbitration proceedings are pending.
In such view of the matter, this writ petition stands closed leaving all rights open to be agitated before the respondents 2 and 3. No costs. Consequently connected Miscellaneous Petition is closed.
