judicial custody on 22.02.2024 for the offences punishable under Sections 8(c) r/w 22(c), 25 & 29(1) of the NDPS Act, in Crime No.4 of 2024 on the file of the respondent, seeks bail.

The case of the prosecution is that on 22.02.2024 at about 14.00 hours, on secret information, the respondent police conducted raid at D.No.23, Ayyanar Kovil Street, K.K.Nagar, Madurai, and found the co-accused uploaded the white colour sack bags in a two wheeler bearing Reg.No.TN-63-AP-3135 and on searching, they found Amphetamine-250 gram, Pseduo Ephedrine-150 gram, White lump like Glucose-300 gram, White stick with crystal shape-850 gram, White Powder with a slight brownish tint-4.750 kgs, White Powder with a glaze- 8 kgs, White Urealike powder-10.500 kg, Brown color Powder-0.900 gram, Pink color Tablet-72 (Nos), Five Liter Plastic can containing acetone liquit- 1 No, Sodium Hydrozide Pellets Extra pure can-2.300 kgs and Brown colour glass bottle-1 No. Hence, the case.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he was falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He 2/5

would further submit that the petitioner has been arrested and remanded to judicial custody on 22.02.2024. Therefore, prayed to grant bail for the petitioner.

The learned Additional Public Prosecutor appearing for the respondent would submit that the offence is grave in nature and the quantity involved in this case is a commercial quantity and the petitioner has 1 previous case similar in nature. Hence, he strongly opposed to grant bail to the petitioner.

5 This Court heard both sides and perused the materials available on record.

Considering the rival submissions made by the learned counsel on either side, nature of offence, and the quantity involved in this case is a commercial quantity and as per prosecution case, the contraband was recovered from this petitioner and thereby, the petitioner failed to comply with the conditions under Section 37 of NDPS Act, I am declined to grant bail to the petitioner, at this stage.
