Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for the issuance of Writ of Mandamus, to direct the respondents No.1 and 2 to rectify the mistake crept in UDR Survey pertaining to the land comprised in Survey No.143/10A1B an extent of 9 1⁄4 cents, erroneously mentioned as 8 1⁄2 cents in patta No.1840, situated at Keelavalavu Village, Melur Taluk, Madurai District, by considering the petitioner's representation dated 22.07.2021 within the time frame.

ORDER

The petitioner seeks to rectify a perceived error in the UDR Survey and the patta issued on such basis.

2. The petitioner states that he purchased the land bearing Survey No.143/10A1B admeasuring 9 1⁄4 cents, which is equivalent to 4027 sq.ft., under a registered sale deed bearing document No.4059/2005 dated 29.12.2005. It is stated by the petitioner that an error crept in during the UDR survey and that, therefore, the petitioner's property is shown as admeasuring 8 1⁄2 cents instead of 9 1⁄4 cents.

W.P(MD)No.13866 of 2021 submitted multiple representations for rectification of the aforesaid error. The present writ petition is filed in these circumstances.

4. Mr.R.Baskaran, learned counsel for the State, accepts notice on behalf of all the respondents. He submits that the petitioner's representation would be considered and disposed of on merits.

5. Accordingly, without going into the merits of the matter, the respondents are directed to consider and dispose of the petitioner's representation dated 22.07.2021 by a reasoned order. Such reasoned order shall be issued after providing a reasonable opportunity to the petitioner, the adjacent land owner, Mr.Subramani and any others who may be affected by such decision. The reasoned order shall be passed within a period of three months from the date of receipt of a copy of this order.

6. W.P.(MD).No.13866 of 2021 is disposed of on these terms without any order as to costs.
