PRAYER:

Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to survey the petitioner land bearing survey No.555/20 situated at Puthukiramam, Poolangal, Aruppukkottai Taluk, Virudhunagar District.

ORDER

The prayer sought for in this writ petition, is for issuance of a Writ of Mandamus, directing the respondents to survey the petitioner's land in Survey No.555/20 situated at Puthukiramam, Poolangal, Aruppukkottai Taluk, Virudhunagar District.

2.Heard Mr.R.Murugappan, learned counsel appearing for the petitioner and Mr.C.Selvaraj, learned Special Government pleader, appearing for the respondents and perused the materials available on record. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

3. According to the petitioner, he is the owner of the land in S.No.555/20 and a Patta was also issued, in favour of the petitioner in Patta No.33. He has been in possession and enjoyment of the property and approached the respondents to Survey the land to fix the boundaries to prevent the encroachment. https://hcservices.ecourts.gov.in/hcservices/

4.The petitioner would state that on 28.06.2017, he sent a representation to the first respondent to survey the land. Since it was not considered, the present writ petition has been filed. 5.Considering the limited scope of the prayer sought for in the Writ Petition, without going into the merits of the case, this Court directs the first respondent to consider the representation of the petitioner dated 28.06.2017 and pass appropriate orders, on merits and in accordance with law, after providing opportunities to the necessary parties, as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.

6.With the above directions, this Writ Petition is disposed of. No costs.
