For Respondent : Mr.T.Senthilkumar, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory bail in Crime No.193 of 2019 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/A2, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 379 IPC r/w Sections 21(1) and 21(2) of the Mines and Minerals (Development and Regulation)Act, 1957, in Crime No.193 of 2019, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner and other accused have illegally transported 1 1⁄2 unit of river sand by using Lorry bearing Registration No.TN-05-V-3622. Hence, the present case has been registered.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case.

CRL OP(MD). No.10791 of 2021 4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the petitioner illegally transported 1 1⁄2 unit of river sand and on the complaint of the Police Officials, the case was registered. He further submitted that the petitioner is having six previous cases of similar in nature. 5.In view of the submission made by the learned Government Advocate (Crl.side), this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
