(Order of the Court was made by S.S.SUNDAR.J.,) This Writ Petition is filed for issuance of a Writ of Mandamus, directing the first respondent to dispose of the application of the petitioner, dated 23.04.2022, for the human rights violations committed against the petitioner, and to initiate appropriate action as against the police officials within a time frame that may be fixed by this Court.

2. Heard Mr.S.C.Herold Singh, learned counsel for the petitioner and Mr.C.Arul Vadivel @ Sekar, learned Standing counsel for the first respondent.

3. The case of the petitioner is that he has filed a complaint before the first respondent in relation to unilateral treatment of the petitioner by Valliyoor Police, which has registered a case in Crime No.399 of 2021 for the offences under Sections 294(b), 323, 324 and 506(ii) of I.P.C. 2/5

It is the grievance of the petitioner that the Valliyoor Police Station has registered a false case against the petitioner and three others in Crime No. 400 of 2021 and the petitioner was subjected to illegal custody and inhuman treatment. It is submitted that the first respondent may be directed to entertain the complaint of the petitioner and dispose of the same within a time stipulated by this Court.

5. The learned counsel for the first respondent states that the first respondent receives every day more than 500 complaints on an average and that the first respondent cannot dispose of the every complaint within a time stipulation.

6. The petitioner has given a criminal complaint against some strangers and the accused in his complaint has given a counter case against the petitioner. The allegations against the police are serious. However, considering the submissions of the learned counsel for the first respondent, the first respondent is directed to consider and dispose of the complaint at the instance of the petitioner, after issuing notice to the concerned parties, within a period of eight months from the date of receipt of a copy of this order. 3/5

7. With the above direction, this Writ Petition is disposed of. No costs.
