ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Sections 417, 376, 313, 323 IPC and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, in Crime No.7 of 2022 on the file of the respondent police, seeks anticipatory bail. 1/3
2. On perusal of the records it is seen that this is the third anticipatory bail petition. The first petition filed by the petitioner in Crl.O.P(MD).No.9004 of 2022 was withdrawn by him on 11.05.2023. Later, he has filed 2nd Crl.O.P(MD)No.11773 of 2022 seeking very same relief. After considering the case on merits that was dismissed on 27.07.2022 stating that the custodial interrogation of the petitioner is necessary since the allegations are serious in nature. Later, during the course of vacation period, the petitioner has filed the present petition and the same was adjourned today.
3. Today, when the matter was taken up for hearing, the learned Additional Public Prosecutor appearing for the respondent police would submit that the petitioner is absconding and the Special Team is formed to arrest him.
4. In such circumstances, there is no question of considering the anticipatory bail petition. Considering the seriousness of the allegations, the petitioner is directed to surrender before the respondent police or Magistrate concerned.
