ORDER : The Court made the following order :- The petitioners/A2, A3, A4 & A8, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 419, 406, 468, 471, 420 and 120B of I.P.C. in Crime No.3 of 2022 on the file of the respondent police, seek anticipatory bail. 2.The case of the prosecution is that the petitioners along with other accused had created bogus documents and executed sale deeds in respect of the property in S.No.276/4 of Vaniyambadi Village, Sivagangai District. Based upon the complaint given by the defacto complainant, a case has been registered against the petitioners and other accused. Hence, the case. https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.9312 of 2023 3.Heard both sides and perused the materials available on record including the First Information Report. 4.It is seen that this Court had already dismissed the application for anticipatory bail filed by the petitioners. After the dismissal of the earlier application, the second petitioner/A3 was arrested by the respondent police. The first petitioner is having five previous cases. That apart, the petitioners 3 and 4 stood as witnesses and impersonated person was identified by them. Therefore the custodial interrogation of the petitioners is very much required in this case.
5.Taking note of the serious allegations made against the petitioners and there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioners. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 12/06/2023 / TRUE COPY / /06/2023 Sub-Assistant Registrar (C.S.)
