Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to execute the proceedings in Na.Ka.No.9585/2017/P1, dated 23.06.2017 to shift the Bar and as well as the retail liquor Shop bearing Shop No.8505 from Velappar Kovil Road in Survey No.515 A/2 to Survey No.515 B/4 in Balakombai Road, Theni District.

ORDER

This writ petition has been filed for issuance of a Writ of Mandamus, directing the first respondent to execute the proceedings in Na.Ka.No.9585/2017/P1, dated 23.06.2017 to shift the Bar as well as the retail liquor Shop bearing Shop No.8505 from Survey No.515 A/2, Velappar Kovil Road to Survey No.515B/4, Balakombai Road, Theni District.

2.Heard both sides.

by the first respondent in Na.Ka.No.9585/2017/P1, dated 23.06.2017, has not yielded any result and hence he is before this Court.

4.The learned counsel appearing for the second respondent fairly submitted that the TASMAC is inclined to accede with the prayer of the petitioner, for which, they have already submitted a representation dated 07.08.2017, in Na.Ka.No.13426/2017/A5, to the third respondent, seeking necessary police protection, which is said to be pending.

5.Such being the case, this Court, without going into the merits of the case, directs the third respondent to consider the representation of the second respondent dated 07.08.2017 and act as expeditiously as possible and render assistance to the second respondent, so as to comply with the directions of the first respondent, dated 23.06.2017. Such an exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.
