O R D E R

An order dated 15.03.2024 of the Revenue Divisional Officer is assailed primarily on the ground of breach of principles of natural justice. In short, the petitioner states that the inquiry notice was not served on him. At the last hearing, learned Government Advocate requested for time to obtain instructions as to whether any acknowledgement is available for service of notice on the petitioner. At today's hearing, he submits that no acknowledgement is available in the records of the official respondent.

2. In view thereof, the impugned order cannot be sustained and is hereby set aside. Consequently, the matter is remanded to the first respondent for reconsideration. After providing a reasonable opportunity to the petitioner and the second respondent, a speaking order shall be issued within twelve weeks from the date of receipt of a copy of this order. The status of revenue records as on date shall be maintained pending disposal of the remanded proceedings. 2/4
