Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the first respondent to issue passport to petitioner on the basis of his application dated 06.05.2022 pending in File No.TR2064187820322 before the first respondent by accepting his explanation within a time frame.

ORDER

Heard the learned counsel on either side.

2. The petitioner seeks issuance of passport and he made an application to the first respondent. The petitioner apprehends that it will not be processed because of the pendency of a criminal case.

3. The learned Special Government Pleader appearing for the second respondent clarifies that the case registered against the petitioner is only at the F.I.R stage. Therefore, there cannot be any impediment for the first respondent to consider the application of the petitioner.

4. The first respondent is directed to process the petition mentioned application and issue the passport to the petitioner subject to the fulfillment of all the other formalities.

5. This Writ Petition is allowed accordingly. There shall be no order as to costs.
