Kaviya, aged 16 years before this Hon'ble Court and to give custody to the petitioner.

O R D E R

(Order of the Court was made by V. BHARATHIDASAN, J.) The petitioner is the father of the detenue. Suspecting that the petitioner's daughter by name R.Kaviya, aged about 16 years, was kidnapped by the third respondent, he said to have given a complaint before the second respondent police. Even though an F.I.R has been registered in Crime No.42 of 2021, on 20.07.2021, so far no action has been taken by the second respondent police to secure the detenue. Hence, the present Habeas Corpus Petition has been filed.

2. When the matter is taken up for hearing today, Mr.S.Ravi, learned Standing Counsel appearing for the State, on instructions would submit that based on the complaint given by the petitioner, already a case in Crime No.42 of 2021 has been registered by the https://hcservices.ecourts.gov.in/hcservices/ 1/2

H.C.P(MD)No.1109 of 2021 second respondent police and the third respodent was also arrested and remanded to judicial custody. He would further submit that the detenue has been secured and is produced before this Court.

3. We have enquired the detenue. On enquiry, she has submitted that she is studying 12th Standard and now, she wants to go with the petitioner/father. The petitioner, who is present before this Court is also willing to take the detenue with him.

4. Considering the fact that the detenue has been secured and she wants to go with the petitioner/father, the Habeas Corpus Petition is closed.
