ORDER

This criminal original petition has been filed to quash the first information report in Cr.No.69 of 2025 pending on the file of the first respondent Police.

2.Today, when the matter is taken up for hearing, the learned Government Advocate(Crl.side) appearing for the first respondent submits that it is a case of Section 307 IPC and the investigation agency has also found some materials for filing final report and they have filed the final report through E.Filing on 27.04.2025. 3.The learned counsel appearing for the petitioner submits that the petitioner filed this quash petition on 28.04.2025. He also submits that though the first respondent Police claims that final report has been filed, it has not been taken on file, till date. Therefore, he insists to quash the proceedings and he also claims that the matter has been amicably compromised between the parties and a memo has also been filed to that effect.

5.This petition has been filed to quash FIR in Cr.No.69 of 2025. Now, final report has been filed. Without ascertaining the materials filed along with the final report, this Court is not inclined to quash FIR. Accordingly, this criminal original petition is dismissed. However,the learned Judicial Magistrate No.5, Madurai is directed to take the final report on file, within a period of four weeks from the date of receipt of a copy of this order. As and when the final report taken on file, the petitioner is permitted to take a certified copy of the charge sheet and file a fresh petition to quash the charge sheet, if so advised. Consequently, connected miscellaneous petition is closed.
