Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the second respondent to implement the order passed in Na.Ka.No.83408/2016/mgm3/dated 18.03.2017 passed by the first respondent and permit the petitioner to join the office of the second respondent on the basis of the petitioner's representation dated 03.07.2017 within the time stipulate by this Court. ORDER

By consent of both sides, this writ petition itself is taken up for final disposal.

2. Heard the learned counsel for the petitioner and Mr.K.Guru, Additional Government Pleader, who takes notice for the respondents.

3.The petitioner was appointed through Employment Exchange as Driver in the office of the Deputy Registrar of Cooperative Societies/the second respondent, Theni District, on 04.04.2001. After sometime, he was transferred to the office of the Deputy Registrar of Cooperative Societies, Periyakulam. Again, he was transferred from Periyakulam to Sivagangai on 07.08.2013. As he is a Driver and his scale of pay is so limited, he is unable to maintain his family needs at two places, namely, one at native place and other at transferred place. representation dated 18.03.2017, explaining his difficulties and also stating that he has one daughter, who is studying 9th standard and one son, who is studying 6th standard respectively and he also has an aged mother, who is suffering from various ailments. 4.The learned counsel for the petitioner stated that there are three vacancies in the office of the second respondent. However, the petitioner's representation has not been considered and hence, the petitioner is before this Court with this writ petition.

5. Since the petitioner, being a Driver, has been working in Sivagangai, in view of transfer, from 2013, the second respondent shall consider the representation of the petitioner, subject to availability of vacancies, within a period of three weeks from the date of receipt of copy of this order.

6.This writ petition is disposed of, with the above direction. No costs.
