O R D E R

Heard the learned counsel appearing for the writ petitioner and the learned Special Government Pleader appearing for respondents 1 and 2.

2. The petitioner's case is that the third respondent without any semblance of right is proposing to convene general body meeting of the petition mentioned Society. The petitioner has therefore given representation to the second respondent. The petitioner wants the second respondent to take action against the third respondent.

3. When the matter was taken up for hearing, the learned Special Government Pleader clarified that the second respondent may not have any role in the matter for the present. Neither the second respondent can direct the third respondent holding the election nor stopping any election process.

4. I endorse the stand taken by the second respondent. The petitioner may have to go before the jurisdictional civil Court for getting 2/4

3 W.P.(MD)NO.12874 OF 2024 injunction order against the third respondent. If the second respondent is to discharge any statutory function, at this stage the petitioner can come before this Court. With this observation and liberty, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
