BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED :02.06.2026

CORAM:

THE HONOURABLE MR JUSTICE MUMMINENI SUDHEER KUMAR K.Gayathri ... Petitioner Vs The Commissiioner, Madurai Municipal Corporation, Madurai District.

... Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to appoint the petitioner on compassionate grounds by considering the petitioner's latest representation dated 01.12.2025 within a stipulated time fixed by this Court.

For Petitioner : Mr. T.A. Ebenezer For Respondent : Mr.S.Vinayak Standing Counsel

O R D E R

The petitioner herein has made a claim for compassionate appointment consequent to the death of her father, namely, late.Krishnan, 1/4

who was working as a Bill Collector in the respondent corporation and died on 17.09.2022.

2. The said claim was said to have been made by the petitioner on 20.09.2022 and the subsequent representation dated 01.12.2025. However, according to the learned counsel for the petitioner, the said request made by the petitioner is not being considered by the respondent. Hence, the petitioner approached this Court by way of filing the present writ petition.

3. The learned Standing Counsel appearing for the respondent corporation submits that the request of the petitioner is still pending for consideration, but the same is submitted beyond the period of three years from the date of demise of the petitioner's father.

4. However, the learned counsel for the petitioner disputed the same and contended that the application is submitted for compassionate appointment within the time.

5. Be that as it may, the request made by the petitioner is admitted 2/4

and pending for consideration before the respondent and therefore, this Court is of the view that it would be appropriate for the respondent to consider the request of the petitioner at the first instance.

6. Accordingly, this Writ Petition is disposed of by directing the respondent to consider the claim made by the petitioner for compassionate appointment consequent to the death of the petitioner's father on 17.09.2022 in accordance with law and pass appropriate orders as expeditiously as possible, at any rate within a period of eight (8) weeks from the date of receipt of a copy of this order.

7. In case there are any rival claimants, the respondent shall take into consideration the objections, if any, filed by the rival claimants and pass orders as directed. No costs.
