The Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure, to withdraw and transfer the suit in G.W.O.P.No.254 of 2024 filed under Guardianship and Wards Act, 1890 from the file of the Family Court, Tiruppur, to the file of the Principal District Court, Trichy District.

ORDER

The petitioner/wife has filed the present Transfer Civil Miscellaneous Petition to withdraw the GWOP.No.254 of 2024 from the file of the Family Court, Tirupur to the file of the Principal District Court, Trichy. 2.A perusal of the affidavit, it is clear that the minor child aged about three years is ordinary residing with the petitioner within the jurisdiction of the Principal District Court, Trichy.

3.Accordingly, as per section 9 of the Guardianship and Wards Act, 1890, it is just and necessary that the GWOP be conducted in which jurisdiction, the minor is ordinarily residing. In view thereof, the Transfer Civil Miscellaneous Petition is allowed as prayed for. No costs. Consequently, connected miscellaneous petition is also clsoed.
