PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of MANDAMUS, to direct the Respondent Nos.1 to 8 to consider the petitioner's representation dated 24.03.2025 and to direct the Respondent Nos. 1 to 8 to cancel the quarrying license granted to the 9th respondent and to initiate appropriate legal action as against the 9th respondent for illegal excess quarrying in the land situated in Survey No.361/1 of Edaikal Part-1 Village,Ambasamuthiram Taluk, Tirunelveli District and for illegally storing and selling the same in Survey No.350/4 in Edaikal Part-1 Village, Ambasamuthiram Taluk, Tirunelveli District, within the time frame stipulated by this Court. ORDER
The present Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of MANDAMUS, to direct the Respondent Nos.1 to 8 to consider the petitioner's representation dated 24.03.2025 and to direct the Respondent Nos. 1 to 8 to cancel the quarrying license granted to the 9th respondent and to initiate appropriate legal action as against the 9th respondent.

2.It is an admitted fact that the petitioner and the 9th respondent are brothers.
3.The learned Counsel appearing for the 9th respondent submitted that already the three brothers are quarrying. License was granted to all the three brothers and they are independently handling each quarry. The petitioner is seeking to take action against the 9th respondent unnecessarily and it is purely a private dispute between the brothers.
4.In view of the above said submission, this Court is not inclined to entertain the present writ petition. If there is any other remedy regarding partition of land and other civil rights, the petitioner is at liberty to seek appropriate remedy before the Civil Court.
5.With the above observations, this Writ Petition is dismissed. There shall be no order as to costs.
