ORDER

The petitioner has filed this petition for a direction to the 2nd respondent police to register a case based on the direction issued by the Judicial Magistrate Court, Natham in CrlMP No.866 of 2024, dated 20.05.2024.

2.The learned Counsel for the petitioner submits that the complaint of this petitioner was not taken on file and therefore he filed a private complaint before the Judicial Magistrate, Natham and a direction was issued in CrlMP No.866 of 2024 on 20.05.2024 to register a case, however, the respondent police have not registered any case. The learned Judicial Magistrate has also sent a reminder to the respondent police in this regard.

3.Considering this submission of the petitioner, this Court has called for a report from the learned Judicial Magistrate, Natham, who has stated that the Inspector of Police, Natham has filed a report on 07.11.2024 that no prima facie case is made to register FIR. 2/4

4.The learned Government Advocate (Crl Side) on instructions submits that subsequent to the orders of the learned Judicial Magistrate, the complaint has been enquired and it has been closed as no criminal offence is made out.

5. In view of the above submission, this petition is closed with a direction to the respondent police to furnish a copy of the closure report to the petitioner enabling him to workout his remedy in the manner known to law.
