ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the alleged offence punishable under Sections 406 and 420 of IPC, in Crime No.not known of 2021 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner has received a sum of Rs.9,00,00/- from the defacto complainant stating that he would arrange a job in Tamil Nadu Tourism Department, but, he did not arrange the job and did not return the amount. Hence, the complaint.
3.The learned counsel for the petitioner submits that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution, but he has been falsely implicated in https://hcservices.ecourts.gov.in/hcservices/ 1/2

4. The learned Additional Public Prosecutor submits that the respondent police could not collect any data for receipt of money as the transactions were made in cash.
5. Since the learned counsel appearing for the petitioner and the learned counsel appearing for the defacto complainant submitted that there is a possibility of settling the issue, this Court referred the matter to the Mediation by order dated 25.08.2021 and directed the Mediator to file a report before this Court.
6. Today, the Mediator has also filed a report stating that the parties have not arrived at a settlement.
7. Considering the facts and circumstances of the case, nature of allegations levelled against the petitioner and also the fact that the money is yet to be recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
8. Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected miscellaneous petition is also closed.
