PRAYER:

Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 2 and 3 to return the certificate of the petitioner's, namely, i)10th Mark Sheet(original), ii)12th Mark Sheet (original), iii) 1st Semester Mark Statement of Engineering, iv) Community Certificate(Original), v)Transfer Certificate and vi) Birth Certificate(Original).

The prayer sought for in the Writ petition for issuance of a Writ of Mandamus, to direct the respondents 2 and 3 to return the certificate of the petitioner's, namely, i)10th Mark Sheet

(original), ii)12th Mark Sheet (original), iii) 1st Semester Mark Statement of Engineering, iv) Community Certificate(Original), v) Transfer Certificate and vi) Birth Certificate(Original). 2.Heard Mr.T.Antony Arul Raj, learned counsel appearing for the petitioner and Mr.R.Rajarajan, learned counsel appearing for the first respondent and Mr.S.Xavier Rajini, learned counsel appearing for the respondents 2 and 3 and perused the materials available on record.

3.The learned counsel appearing for the respondents 1 and 2 would submit that the petitioner joined in the second respondent's college in the year 2015-2016 and after completing the Semester, she discontinued her studies. It is further submitted that the respondents 2 and 3 are ready to return the original certificates, if the petitioner pays the due amount of Rs.24,650/-. It is further submitted that at time of issuing the transfer certificate, the parents and the petitioner have to sign in the register of the second respondent college.

4.In view of the above submission, the petitioner is directed to approach the second respondent with due amount and on such payment, the second respondent shall return the original certificates to the petitioner and at the time of producing the certificates, the petitioner shall accompany the parents and sign in the register as required by the second respondent. 5.With the above directions, this Writ petition is disposed of. No costs.
