ORDER

Seeking a writ of Mandamus directing the respondents to include the name of the petitioner bearing Application No.194281 for General Counselling and Application No.156 for Industrial Consortium Counselling in the ranking list and call him for the ongoing Counselling for admission for the academic year 2017-2018 in Bachelor of Engineering (B.E.,) Course under General as well as Industrial Consortium quota conducted by the respondents, this writ petition has been filed.

2. Mr.M.Rajarajan, learned Standing Counsel takes notice for the respondents.

3. By consent, the writ petition itself is taken up for final disposal.

The case of the petitioner is that the petitioner has passed out +2 in CBSE examinations with A1 Grade in all subjects except Chemistry wherein he secured A2 Grade in the academic year 2017-2018, by securing 93% of marks. The petitioner has applied for Engineering Course Admissions through Online with TNEA and he has also paid necessary fees and his application number is 194281. Further, the petitioner has also applied for Admissions under Industrial Quota and also paid fees. However, the name of the petitioner has not been included in the rank list. On enquiry, the petitioner has been informed that the hard copies of the credentials were not reached the respondents. Thereafter, the petitioner sent one more set of hard copies through Speed Post, but, the same was returned.

5. According to the petitioner, the Counselling for the General Quota started from 23.07.2017. Though the petitioner approached the respondents in person, the same did not evoke any positive response. If the request of the petitioner for including his name in the ranking list is considered, no prejudice would be caused to any one. Thus, he prays for appropriate orders to consider his claim for including his name in the Engineering Counselling for the academic year 2017-2018.

6. In support of his claim, the petitioner relied on a recent judgment of this Court in Milind,L. v. Union of India and 2 others [W.P.No.16581 of 2017, decided on 30.06.2017], wherein, the respondents therein were directed to include the name of the petitioner's son therein for MBBS Counselling for the year 20172018, based on a representation given by him in this regard.

7. Heard the learned Counsel for the petitioner as well as the learned Standing Counsel appearing for the respondents and perused the materials available on record.

A mere reading of the typed set of papers would make it clear that the petitioner passed out +2 examinations in CBSE pattern and secured 93% of marks with A1 Grade in all subjects except Chemistry, in which, he secured A2 Grade. He applied through Online for Engineering Counselling and his application number for General Counselling is 194281 and for Industrial Consortium Counselling, his application number is 156.

Once Online application is filled up by a candidate and a specific number is allotted for him, then, the question of rejecting his claim for Counselling on the ground that the filledin Online application along with necessary enclosures did not reach the respondents in time, in the opinion of this Court, does not warrant at all, for the reason that when the candidates apply for

Engineering Admissions, they must provide all necessary details that are relevant for consideration even at that time itself and the delay in submitting the filled-in Online application form along with enclosures, viz., hard copies of relevant documents, cannot be cited as a ground for rejection of his candidature for Engineering Admissions. Then, it would definitely prejudice the valuable future of a student, who carries a lot of dreams to achieve in his life.

It is the prime contention of the learned Counsel for the petitioner that the petitioner has already provided all necessary details at the time of applying for Engineering Admissions through Online in the official website of the respondent University and the hard copies of those documents are directed to send through post only to enable them to verify the information provided in the Online application form.

Considering the peculiar facts and circumstances of the case, this Court directs the respondents to include the petitioner's candidature in the Counselling for Engineering Admissions for both the General Counselling as well as Industrial Consortium Counselling in accordance with the relevant rules governing the Engineering Admissions, so to say, he has already provided necessary information through Online while applying for Engineering Admissions for the academic year 2017-2018. The petitioner is also directed to submit the hard copies of all relevant documents to the respondents forthwith.

12. Accordingly, this writ petition is disposed of as above. No costs.
