ORDER : The Court made the following order :- The petitioner/A1, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Section 379 IPC and Section 21(1) and 21(2) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.146 of 2021, seeks anticipatory bail.

2.The case of the prosecution is that the petitioner has illegally transported one unit of river sand. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent, he has not committed any offence as alleged by the prosecution, but he has been falsely implicated in this case.

No.10840 of 2021 4.The learned Government Advocate (Crl.side) appearing for the respondent police, on instructions, would submit that the petitioner has one previous case of similar in nature in Crime No.58 of 2019 on the file of the Vallathirakottai Police Station, Pudukkottai District for the offence under Section 379 I.P.C r/w Section 21(1)

(2) of Tamil Nadu Miles and Minerals (Development and Regulation) Act, 1957.

5.Considering the submission made by the learned Government Advocate (Crl.side) that the petitioner is is having one previous case of similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
