Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to take appropriate steps to register the two unregistered copies of sale deeds, dated 20.06.1995 and 30.03.2004 through fourth respondent and return the same to petitioner after proper registration.

ORDER

This writ petition is filed seeking a writ of Mandamus to direct the respondents to register the two unregistered copies of sale deeds, dated 20.06.1995 and 30.03.2004, submitted by the petitioner, through fourth respondent and return the same to him after proper registration.

2.Heard both sides.

https://hcservices.ecourts.gov.in/hcservices/ 3.The case of the petitioner is that he submitted two unregistered sale deeds along with challan showing payment of stamp

duty as well as penalty to the third respondent through the fourth respondent, for registration and since the third respondent informed him that the said sale deeds are not available with him, the petitioner made a representation, dated 20.07.2017, to the respondents, seeking to register the sale deeds by using the copies of the same. Since the same has not been considered so far, the petitioner is before this Court.

4.The learned counsel appearing for the petitioner would submit that now the petitioner has represented the sale deeds for registration and the petitioner confines his prayer only to direct the respondents 3 and 4 to register and return the same to the petitioner, for which, the learned Government Advocate appearing for the respondents, has no serious objection.

5.Considering the limited scope of the relief sought for, this Court, without going into the merits of the petitioner's claim, directs the respondents 3 and 4 to consider the sale deeds represented by the petitioner and take necessary action for registration, after affording due opportunity of hearing to the petitioner, within a period of four weeks from the date of receipt of a copy of this order.
