Respondent Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to register the petitioner's sale deed in regard to selling his property in Survey No.1382/8A2 to an extent of 0.1.50 Ares D.No.7/126, Middle Colony Street, Pambukoil Sandhai, Kadayanallur Taluk, Tenkasi District based on House Tax Receipt and his mothers legal heir certificate as well as based on his representation dated 23.04.2024 within the time limit that may be stipulated by this Court.

ORDER

Heard both sides.

2.The petition mentioned property belonged to one Madathi. Madathi had daughter by name Tamil Selvi. Tamilselvi got married to one Pandaram. Through the said wedlock, three sons were born namely, Boopathi, Poovaiah and Poobalan. Pandaram passed away long back. Thereafter, Tamilselvi died on 06.04.2021. Copy of the death certificate has been enclosed in the typed set of papers. Thereafter, her mother, Madathi passed away on 18.07.2021. Poovaiah died on 07.11.2022. It is seen from the legal heir certificate of Tamilselvi that Poovaiah was unmarried. Therefore, the property can be dealt with by Boppathi and Poobalan. As and when, any document is jointly presented by Boopathi and Poobalan, the same will be accepted for registration by the respondent subject to fulfillment of other usual formalities. I have only declared that the registering authority will not insist on obtaining legal heir certificate of Poovaiah and Madathi. I have not relaxed any of the other 2/4

procedural or administrative requirements. It is for the respondent to take a call in the matter.
