Prayer: Criminal Original Petition was filed under Section 482 of Criminal Procedure Code, 1973, to direct the 3rd Respondent herein not to harass the Petitioner in the name of enquiry/investigation and act in accordance with law.

ORDER

This petition has been filed seeking a direction to the third respondent herein not to harass the Petitioner in the name of enquiry/investigation.

2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based on the complaint given by the fourth respondent, enquiry was undertaken in CSR No.125 of 2021 dated 04.08.2021. During the course of enquiry, it was found that it is a money dispute pending between the petitioner and the fourth respondent and therefore, the https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.10903 of 2021 representation / complaint given by the fourth respondent came to be closed on 12.09.2021.

3.It was observed in the closure report that the petitioner did not appear before the enquiry officer and co-operate with the same and therefore, concluded the enquiry. Even though a direction was issued by this Court to the petitioner to appear before the enquiry officer, the same has not been complied with. But, however, the complaint has been closed for the aforesaid reasons. 4.Since the complaint has been closed by the respondent police, the harassment may not arise. Therefore, nothing survives for further adjudication or consideration. Accordingly, this Criminal Original Petition is dismissed.
