Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the second respondent to complete the enquiry proceedings in O.Mu.A3/945/2025 dated 21.02.2025 on the basis of the representation of the petitioner dated 05.02.2025. For Petitioner : Mr.D.Senthil For Respondents : Ms.K.Malathi Addl. Govt. Pleader (RR1 to 4)

ORDER

This writ petition is filed seeking a direction to the second respondent to complete the enquiry in his proceedings in O.Mu.A3/945/2025 dated 21.02.2025 on the basis of the representation submitted by the petitioner dated 05.02.2025.

2. Heard the arguments of Mr.D.Senthil, learned counsel appearing for the petitioner and Ms.K.Malathi, learned Additional Government Pleader, who took notice for the respondents 1 to 4. Since no adverse order is going to be passed, notice to the respondents 5 and 6 is dispensed with. By consent of both sides, this writ petition is taken up for final disposal at the admission stage itself.

It is the case of the petitioner that the fifth respondent was assigned with the land measuring an extent of 2.02.5 Hectares situated at S.No.162/3 in Melathuraiyur Village, Kannamangalam Post, Ilaiyangudi Taluk, Sivagangai District. The assignment was made for the purpose of agricultural cultivation. Violating the conditions, the fifth respondent sold the same to the 6th respondent and the patta has also been transferred to the 6th respondent. The petitioner therefore submitted a representation before the second respondent on 05.02.2025 seeking to cancel the assignment in favour of the 5th respondent and to cancel the patta granted in favour of the 6th respondent. As the said representation has not been considered, the petitioner has come forward before this Court.

Ms.K.Malathi, learned Additional Government Pleader, who took notice for the respondents 1 to 4, would submit that already the second respondent sought a report from the third respondent and final order will be passed by the second respondent, after receipt of the report from the third respondent.

5. In view of the submission made by the learned Additional Government Pleader appearing for the respondents 1 to 4, without going into the merits of 3/5

the matter, the second respondent is directed to complete the enquiry initiated by his proceedings in O.Mu.A3/945/2025 dated 21.02.2025 and pass final orders on its own merits within a period of twelve weeks from the date of receipt of a copy of this order.

6. With the above direction, this writ petition stands disposed of. No costs.
