PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the respondents not to survey the land in Survey No.3/3, total extent is 8 cents, which is situated at Royappanpatti Village, Uthamapalayam Taluk, Theni District, based on petitioner's representation, dated 24.04.2025. For Petitioner :

ORDER

The petitioner herein seeks a direction to the respondents not to survey the land in Survey No.3/3, to an extent of 8 cents, situate at Royappanpatti Village, Uthamapalayam Taluk, Theni District, by considering his representation, dated 24.04.2025.

2. According to the petitioner, his father purchased 3.75 cents of land in Survey No.3/3 under a registered sale deed, dated 13.11.1991.

3. Learned counsel for the petitioner submits that since the petitioner's father purchased 3.75 cents of land in Survey No.3/3, the entire extent in Survey No.3/3 has to be properly surveyed with reference to the title

documents of the respective parties. It is specifically submitted that if the property situate in Survey No.3/3 is surveyed with reference to the title documents of the respective parties and the relevant revenue records, the petitioner is not having any objection.

4. The above statement made by the learned counsel for the petitioner is recorded.

Mr.A.Baskaran, Additional Government Pleader, who takes notice for the respondents 1 to 4, submits that the fifth respondent already submitted a representation, seeking survey of the land situate in Survey No. 3/3 and, at this stage, the petitioner has submitted a representation, making a request not to survey the said land.

6. In view of the statement made by the learned counsel for the petitioner that if the land situate in Survey No.3/3 is surveyed with reference to the title documents of the respective parties and other relevant revenue records the petitioner may not have any objection, this Court is inclined to direct the second respondent to issue notice to the petitioner, the fifth respondent and other interested parties, and take a decision with regard to survey of the land situate in Survey No.3/3, within a period of eight weeks from the date of receipt of copy of this order.

7. Writ Petition is disposed of accordingly. No costs. Consequently, the connected W.M.P.(MD) No.9893 of 2025 is closed 02.06.2025 NCC :
