Mr.M.Sakthi Kumar, Government Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.60 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner, apprehending arrest at the hands of the respondent Police, in connection with a case in Crime No.60 of 2023, for the offence under Sections 147, 148, 294(b), 323, 324 and 506(ii) IPC r/w. Section 3 of TNPPDL Act, has filed this petition seeking anticipatory bail.

2. The case of the prosecution is that due to property dispute, the accused persons assaulted the defacto complainant with hands. Hence, the case.

3. The learned counsel appearing for the petitioner submits that earlier, the 1/3

petitioner has moved a petition before this Court in Crl.O.P.(MD)No.4978 of 2023 and this Court, by order dated 16.03.2023, granted anticipatory bail to the petitioner. However, due to some reasons, the petitioner could not furnish the sureties in time. Therefore, he filed a petition in Crl.M.P.(MD)No.6156 of 2023 seeking extension of time to furnish the sureties and the same was allowed by order dated 18.04.2023. In spite of the same, the petitioner could not furnish the sureties in time. Therefore, the petitioner has filed this petition.

4. The learned Government Advocate (Crl. Side) opposes for grant of anticipatory bail on the ground that the petitioner is having three previous cases.

5. Considering the nature of offence, the antecedent of the petitioner and also considering the conduct of the petitioner in not furnishing the sureties in time, despite granting extension of time to comply with the conditions imposed by this Court, while granting anticipatory bail in Crl.O.P.(MD)No.4978 of 2023, this Court is not inclined to grant anticipatory bail to the petitioner.
