(W.P.(MD)Nos.13831 to 13835 of 2017) Common Prayer: Writ Petition filed under Article 226 of Constitution of India, praying for issuance of a Writ of Mandamus, directing the respondents to refix and revise the petitioners' pay for the period from 01.09.2013 to 31.03.2014, 01.09.2013 to

31.05.2014, 01.09.2013 to 31.03.2014, 01.09.2013 to 31.10.2014,01.09.2013 to 31.07.2014 respectively based on the terms of settlement dated 13.04.2015 entered under Section 12(3) of Industrial Disputes Act, 1947 by giving pay revision at the rate of 5.5% and further directing the respondents to pay him the difference amount in his salary for the period from 01.09.2013 to 31.03.2014, 01.09.2013 to 31.05.2014, 01.09.2013 to 31.03.2014, 01.09.2013 to 31.10.2014,01.09.2013 to 31.07.2014 respectively and to pay difference in his retirement benefits including monthly pension, gratuity, leave salary, commuted value of pension and all other attendant benefits payable from 01.04.2014, 01.06.2014, 01.04.2014, 01.11.2014,01.08.2014 respectively to till date together with interest at the rate of 18% per annum based on the said settlement.

The petitioners have come to this Court seeking a writ of mandamus to direct the respondents to refix and revise their pay for the period from 01.09.2013 to 31.03.2014, 01.09.2013 to 31.05.2014, 01.09.2013 to 31.03.2014, 01.09.2013 to 31.04.2014 respectively based on the terms of settlement dated 13.04.2015 entered under Section 12(3) of Industrial Disputes Act, 1947 by giving pay revision at the rate of 5.5% and further directing the respondents to pay them the difference amount in their salary for the period from 01.09.2013 to 31.03.2014, 01.09.2013 to 31.05.2014, 01.09.2013 to 31.03.2014, 01.09.2013 to 31.10.2014 and 01.09.2013 to 31.07.2014 respectively and to pay difference in their retirement benefits including monthly pension, gratuity, leave salary, commuted value of pension and all other attendant benefits payable from 01.04.2014, 01.06.2014, 01.04.2014, 01.11.2014, 01.08.2014 respectively to till date together with interest at the rate of 18% per annum based on the said settlement.

3. Expressing their grievances, these petitioners have given representations to the respondents. However, the said representations have not been disposed of so far. Therefore, the petitioners are before this Court with these writ petitions.

4. The learned Standing counsel for the respondents, who

take notice for the respondents, on instructions, sought time to consider the representations of the petitioners.

5. In view of the said submission, considering the limited scope of the matter, without going into the merits, the 2nd respondent is directed to consider the representations of the petitioners and pass orders, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

These writ petitions are disposed of with the above direction. No costs.
