Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 2nd respondent to consider petitioner's objection dated 06.02.2026 and consequently forbear the respondents from registering any sale deed or document in respect of the subject properties situated in Survey No.744/1 measuring 1 acre 38 1⁄2 cents in Patta No.836, in Survey No.775/A1 measuring 74 cents, in Survey No.775/A8C measuring 37 cents, in Survey No.775/A8B measuring 3 cents in Survey No.775/A9 measuring 1/4

1 acre 1 1⁄4 cents and in Survey No.775/B2B measuring 1 acre 23 1⁄2 cents including petitioner undivided share.

ORDER

Heard the learned counsel for the petitioner. 2.The case of the petitioner is that the third respondent is the brother of the petitioner. The property originally belonged to the father and he has died intestate and therefore, the petitioner has also got a share in respect of the property in survey No.744/1 etc in Manavadi village. It is her case that the third respondent is trying to alienate the petitioner's share also. If the petitioner does not want the third respondent to present any document, it is for the petitioner to approach the competent Civil Court and get appropriate relief in her favour. 2/4

3.Since the petitioner has submitted her objection, the same shall be treated as an objection as and when any document is presented in respect of the said property, due notice has to be issued to the petitioner, the executant / claimant of the document and any other interested persons and the second respondent shall conduct an equiry and pass orders in the manner known to law.
