ORDER

This Writ Petition has been filed by the petitioner to quash the order passed by the second respondent dated 25.04.2025, rejecting the permission for conducting 'Adal Padal' programme on 09.05.2025 and consequently, direct the second respondent to grant permission to conduct 'Adal Padal' programme on 09.05.2025 in connection with Chithirai festival of 'Sri Oodai Manthai Kaliamman Kovil' situated at M.Kallupatti, Peraiyur Taluk, Madurai District.

According to the petitioner, he is the Executive Committee Member of 'Oodai Manthai Kaliamman Kovil' situated at M.Kallupatti, Peraiyur Taluk, Madurai District and villagers decided to conduct festival for the said temple from 06.05.2025 to 09.05.2025 and also, they decided to conduct cultural programmes, namely, 'Karakattam, Gramiya Thenpanghu Padal and Adal Padal' from 06.05.2025 to 09.05.2025. The second respondent granted permission to conduct 'Karakattam' and 'Gramiya Thenpanghu Padal' programmes, but rejected the request for 2/6

conducting 'Adal Padal' programme on 09.05.2025, without assigning any reason. 'Adal Padal' programme is one of the cultural programmes and the villagers have decided to conduct the said programme and thereby, the order passed by the second respondent in respect of declining to grant permission for conducting 'Adal Padal' programme on 09.05.2025 is liable to be set aside.

The learned Additional Pubic Prosecutor appearing for the respondents, on instructions, submits that they received the representation of the petitioner for conducting the temple festival and the cultural programmes from 06.05.2025 to 09.05.2025. Permission was granted for 'Karakattam and Gramiya Thenpanghu Padal' programmes on 06.05.2025 and 08.05.2025, but permission was rejected for 'Adal Padal' programme on 09.05.2025, due to law and order issue. Therefore, the second respondent passed the reasoned order and the present petition is liable to be dismissed.

The petitioner and the villagers decided to conduct Chithirai festival in 'Oodai Manthai Kaliamman Kovil' situated at M.Kallupatti, Peraiyur Taluk, Madurai District, from 06.05.2025 to 09.05.2025, to that effect, they approached the second respondent for grant of permission to conduct cultural programmes and the second respondent permitted to conduct festival and cultural programmes on 06.05.2025 and 08.05.2025, at the same time, rejected the permission for conducting 'Adal Padal' on 09.05.2025 without assigning any reason. Since the 'Adal Padal' programme is one of the cultural programmes, the second respondent without assigning any reason simple rejected the request of the petitioner. Therefore, the rejection order passed by the second respondent in respect of conducting 'Adal Padal' programme on 09.05.

2025 is liable to be set aside. Accordingly, this Writ Petition is allowed and the impugned order passed by the second respondent in respect of rejection to grant permission for 'Adal Padal' programme on 09.05.2025 in connection with 'Oodai Manthai Kaliamman Kovil' festival situated at M.Kallupatti, Peraiyur Taluk, Madurai District, is set aside. Permission is granted to conduct 'Adal Padal' programme on 09.05.2025, without any law and order issue.

provide adequate police protection and monitor the entire events. The petitioner also ensures that there is no any praise of particular community people and without any obscene act, programme has to be conducted. No costs.
