Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents herein to disburse the retirement benefits, gratuity, provident fund and all other monetary benefits to the petitioner within stipulated time fixed by this Court based on the petitioner's representation, dated 21.03.2022. For Petitioner : Mr.C.Padmaraj For Respondents : Mr.M.Ramesh, Government Advocate.

ORDER

By consent of both the parties, this Writ Petition is taken up for final disposal.

2. The grievance of the petitioner is that though he had retired from service on 31.05.2019, the terminal benefits have not been disbursed to him. Today, when the matter came up for admission, the learned Government Advocate, on instructions from the fifth respondent, submitted that the 2/5

retirement benefits could not be disbursed, since the Society was running at a loss and that, if twelve (12) weeks' time is granted to them, they would ensure that the terminal benefits are settled in favour of the petitioner herein.

3. Though the fifth respondent herein had sought for twelve weeks' time, this Court had taken note of the fact that the petitioner has been waiting for more than three years for the terminal benefits and therefore, if eight (8) weeks' time is granted to the fifth respondent to settle the dues, the ends of justice could be secured.

4. Accordingly, there shall be a direction to the fifth respondent herein to forthwith disburse all the terminal benefits to the petitioner herein together with interest at the rate of 6 % per annum within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. This Writ Petition stands allowed accordingly. There shall be no order as to costs.
