O R D E R
The petitioner has come forward with this Writ Petition for issuance of a Writ of Mandamus directing the respondent to grant permission and protection for conducting Cricket Tournament scheduled to be held on 29.07.2017 and 30.07.2017 at about 08.00 AM to 06.00 PM at Sports Ground near V.Chellayeepuram, Veerapandi Village, North Taluk, Thirumalpuram Post, Madurai-14 based on the petitioner's representations dated 15.07.2017 and 24.07.2017.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
3. The learned counsel for the petitioner submitted that the petitioner and his team decided to conduct Cricket Tournament on 29.07.2017 and 30.07.2017 at Sports Ground near V.Chellayeepuram, Veerapandi Village, North Taluk, Thirumalpuram https://hcservices.ecourts.gov.in/hcservices/
Post, Madurai-14, at village level and this is purely to promote sports. In this connection, representations were given to the respondent on 15.07.2017 and 24.07.2017, with a request to grant permission for conducting the Cricket Tournament in the above said dates. However, the respondents have not yet considered the said representations and hence, the petitioner is before this Court with this Writ Petition.
4. The learned Special Government Pleader appearing for the respondents, on instructions, submitted that the area in which the tournament proposed as communal sensational area. Therefore granting permission is likely to create a law and order problem or communal unrest. Since the Cricket Tournament is organised by youngsters belonging to all community, the respondents need not prohibit. The police also is expected to utilise these opportunities to unite the youngsters forgetting their difference, as it is one of the constitutional obligations of the State.
5. Taking into consideration the facts and circumstances of the case, the Writ Petition is disposed of with the following direction:
The second respondent/Inspector of Police, Oomachikulam Police Station, Madurai, is directed consider the representations of the petitioner, dated 15.07.2017 and 24.07.2017 and to give permission to the petitioner and the organizers, for conducting Cricket Tournament in Sports Ground near V.Chellayeepuram, Veerapandi Village, North Taluk, Thirumalpuram Post, Madurai-14 on 29.07.2017 and 30.07.2017 during day time from 08.00 a.m., to 6.00 p.m., subject to any reasonable restrictions that may be imposed by the second respondent in the interest of public and to preserve the law and order and communal harmony.
No costs.
