ORDER

(Order of the court was made by R.VIJAYAKUMAR., J) The present review application has been filed by the respondents in WA(MD)No.940 of 2018 seeking to review the order passed by this Court on 22.10.202024.

2. The appellant had filed WP(MD)No.14622 of 2012 seeking compassionate appointment on the ground that her husband who was employed as a Conductor had passed away on 06.03.2006 while he was in service. The said writ petition was dismissed by this Court on 14.02.2013. Challenging the same, the writ petitioner had preferred WA(MD)No.960 of 2018, which was disposed of on 22.10.2024 directing the Transport Corporation to provide compassionate appointment to the writ petitioner within a period of eight weeks from the date of receipt of copy of that order. Seeking to review the said order, the present review application has been filed by the Transport Corporation.

3. According to the learned counsel appearing for the Transport Corporation, a seniority list is being maintained for the purpose of providing compassionate appointment on the basis of the date of death of the employee.

4. In such circumstances, the writ petitioner cannot be granted compassionate appointment jumping the queue. He also furnished written instructions received from the Transport Corporation dated 20.11.2025, wherein it is stated that the writ petitioner has been placed in serial No.25 in Nagercoil region and serial No.58 in Tirunelveli region and as and when seniority reaches the petitioner's name will be considered for suitable appointment on compassionate grounds.

5. In view of the above deliberations, the order of the coordinate bench in the writ appeal is hereby clarified to the effect that the writ petitioner shall be provided compassionate appointment as and when she reaches the seniority.

6. With the above clarification, this review application is disposed of.
